STANDARDS

Our inspections are performed and reports are prepared in accordance with standards of the American Society of Home Inspectors (ASHI). Wood Destroying Insect and Substructure Moisture Inspections are performed in accordance with standards of the Tidewater Pest Control Association (TPCA).

We pray for Divine guidance regarding our inspections. We subscribe to the highest standards of Judeo-Christian ethics and endeavor to honor God and to glorify Jesus Christ by our conduct and the quality of the results. We intend to serve our clients the way we would like to be served.

LIMITATIONS

The Inspection and Report rely on the opinions, judgment and experience of the inspector and are not intended to be technically exhaustive. Your inspector is a generalist and is not a licensed engineer or expert in every craft. If the inspector recommends consulting other specialized experts, this must be done at client's expense.

The inspector is not required to move furniture, carpeting, wall coverings, insulation, personal or stored items, or to dismantle any systems or equipment. Window, electrical receptacles and switches are spot-checked. Inspection does not cover items or conditions that may only be discovered by invasive methods.

The following are not within the scope of this inspection:

1) Building code compliance, zoning violations, property boundary lines and encroachments
2) Geological stability and underground storage tanks
3) Environmental hazards including toxic mold, asbestos, lead paint, radon
4) Value of property and estimates of repairs
5) Security, solar and sprinkler systems
6) Condition of heat exchangers in furnaces
7) Private water and septic systems, pools, hot tubs, saunas (unless included for an additional fee)

NO WARRANTY OR GUARANTEE

The Inspection and Report are for the exclusive use of the Client. Nothing said or written is to be construed as a warranty or guarantee or as any form of insurance. Liability for mistakes or omissions is limited to a refund of the fee paid even in the event of negligence or breach of contract. It is further agreed that this contract shall not be subject to the Virginia Consumer Protection Act.

DISPUTE RESOLUTION

In the event of any dissatisfaction concerning interpretation of this contract or results of this inspection, Client agrees to notify Amer immediately, before making repairs or replacement, and to describe the issues in writing. Any controversy or claim that is not settled informally shall be resolved by arbitration administered in accordance with the rules for Commercial Arbitration of the American Arbitration Association except that the parties shall select an arbitrator who is familiar with the inspection industry. It is further agreed that failure to abide by these provisions constitutes a material breach of this contract, which prevents Client from asserting any claim against Amer or the inspector.

Any claim must be brought within one year of the date of the inspection or will be forever waived and barred.

Client agrees to reimburse Amer for expenses incurred in defense of any disputes that are not settled in favor of the Client. Expense will include the time of the inspector. If any part of this contract is ruled to be invalid, the rest shall remain valid. We regret any need for this explicit statement of Dispute Resolution.
